Agreement

This Terms of Service (“Agreement”) constitutes a legally binding agreement between you or the entity you represent (“you” or “your”) and Fusewing (“we,” “us,” or “our”) governing your use of Fusewing’s services, products, and software applications (“Services”). By using our Services & Products you agree to comply with this Agreement.

Agreement
This is an agreement between you or the entity that you represent (hereinafter “you” or “your”) and Fusewing (hereinafter “Fusewing”) governing your use of Fusewing’s services & Products.

Parts of this Agreement
This Agreement consists of the following terms and conditions (hereinafter the “General Terms”) and any terms and conditions specific to the use of individual services (hereinafter the “Service Specific Terms”). In the event of a conflict between the General Terms and Service Specific Terms, the Service Specific Terms shall prevail.

Acceptance of the Agreement
You must be of legal age to enter into a binding agreement in order to accept the Agreement. If you do not agree to the General Terms, do not use any of our services. You can accept the Agreement by checking a checkbox or clicking on a button indicating your acceptance of the Agreement or by actually using the services.

Description of Service
We provide cloud software and applications for businesses, including associated offline and mobile applications (“Service” or “Services”). You may use the Services for your personal and business use or for internal business purposes in the organization that you represent. You are responsible for obtaining access to the Internet and the equipment necessary to use the Services.

Beta Service
We may offer certain Services as closed or open beta services (“Beta Service” or “Beta Services”) for the purpose of testing and evaluation. We reserve the right to fully or partially discontinue any of the Beta Services at any time with or without notice to you. You agree that Fusewing will not be liable to you or any third party for any harm related to the modification, suspension, or discontinuance of any of the Beta Services.

Free Trial
If you register for a free trial of one or more Services, Fusewing will make the applicable Services available to you on a trial basis free of charge until the earlier of (i) the end of the free trial period, (ii) the start date of the paid subscription period for the applicable Services, or (iii) termination by Fusewing in its sole discretion. Any data entered during the free trial will be permanently lost unless you purchase the corresponding paid subscription.

User Sign-Up Obligations
You need to sign up for a user account by providing all required information. You agree to provide true, accurate, current, and complete information about yourself and maintain and update this information as necessary.

Restrictions on Use
You shall not: (i) transfer the Services or otherwise make it available to any third party; (ii) provide any service based on the Services without prior written permission; (iii) allow user licenses to be shared or used by more than one individual; (iv) attempt to disassemble, reverse engineer or decompile the Services; (v) use the Services in any manner that could damage, disable, overburden, or impair any server, network, or computer system; (vi) use the Services to send or store material containing harmful codes; (vii) host, display, upload, modify, publish, transmit, store, or share any information that belongs to another person without consent; (viii) violate any applicable local, state, or national law; or (ix) create a false identity to mislead any person.

Spamming and Illegal Activities
You agree not to use the Services for illegal purposes or for the transmission of material that is unlawful, defamatory, insulting, harassing, or otherwise objectionable. We reserve the right to terminate your access to the Services if there are reasonable grounds to believe that you have used the Services for any illegal or unauthorized activity.

Third Party Applications
Access and use of any third-party applications may require acceptance of their terms. You acknowledge and agree that Fusewing is not liable for any third-party applications and may suspend or restrict access to them without notice.

Fees and Payments
The Services are available under subscription plans of various durations. Payments for subscription plans can be made only by credit/debit card. Or Mandate, Your subscription will be automatically renewed at the end of each subscription period unless you inform us otherwise at least seven days prior to the renewal date. Payments are non-refundable under any circumstances. If unsatisfied with the Services, you may cancel your subscription from the next billing cycle. Fusewing will provide priority support to resolve your concerns and enhance your experience.

Hiring Developers
No Refund Policy: Once a developer or group of developers is hired, the fees are non-refundable. Commitment to Deliver: If you are not satisfied with the deliverables, Fusewing will provide 1:1 support to ensure that the agreed requirements or scope are fulfilled, at no additional cost. Scope and Additional Work: Any tasks outside the agreed-upon scope or requirement list will be considered additional work and will be charged at the standard hourly rate. Creative Process: Programming is inherently a creative task that requires time and expertise to craft solutions from scratch or to improve existing systems. Clients are advised to provide detailed and clear requirements to facilitate efficient project execution. Group Hiring: The same terms apply to the hiring of a group of developers. Fusewing ensures that collaborative efforts align with the agreed requirements, with any deviations or additional features being billed as per the standard hourly rate.

Personal Information and Privacy
Your personal information is governed by Fusewing’s Privacy Policy. You are responsible for maintaining confidentiality of your account information and for all activities that occur under your account.

Communications from Fusewing
The Service may include certain communications from Fusewing, such as service announcements and administrative messages. You cannot opt-out of receiving essential service communications.

Complaints
If we receive a complaint regarding your activities, we will forward it to your registered email. You must respond directly to the complainant within ten days.

Inactive User Accounts Policy
We reserve the right to terminate unpaid user accounts that are inactive for a continuous period of 60 days. You will be notified before any data deletion occurs.

Data Ownership
You own the content created or stored by you. Fusewing will not use your content for commercial purposes without your permission, but we may access and store it as necessary to provide the Services.

User Generated Content
You are solely responsible for any content you publish. By making content available, you affirm you have the right to do so.

Sample Files and Applications
Fusewing may provide sample files for demonstration purposes. We make no warranty as to their accuracy or usefulness.

Trademark
Fusewing’s trademarks may not be displayed or used without prior permission.

Disclaimer of Warranties
The Services are provided on an “as-is” basis. Fusewing disclaims all warranties of any kind.

Limitation of Liability
Fusewing shall not be liable for any consequential, incidental, or indirect damages arising out of your use of the Services. In no event shall Fusewing’s total liability exceed ₹50,000 or the fees paid during the twelve months prior to the event causing the liability.

Indemnification
You agree to indemnify and hold harmless Fusewing from any claims arising from your use of the Services.

Governing Law and Jurisdiction
Any disputes shall be settled exclusively by the courts in India.

Suspension and Termination
We may suspend or terminate your account if we suspect illegal activity or if you violate the Agreement. You may terminate your account at any time.

Modification of Terms of Service
We may modify this Agreement upon notice to you. Continued use of the Services constitutes acceptance of the modified Agreement.
